Auto insurance fraud in Florida is at an all time high. It's no coincidence that Florida's newly elected Chief
Financial Officer is Jeff Atwater. Atwater
has been working with the Division of Insurance Fraud, and he has
recently shown some great initiative here in Florida. Tampa, currently experiencing tremendous increases in
fraud, now has a new PIP squad in place to combat it. Also, a new senior attorney has been hired in Miami to

On December 2nd, 2010, American Mercury Insurance, filed a notice with the Department of Insurance of their
intent to withdraw from the Florida Property Market. This market includes all homeowner, renter, and
condominium policies in the state of Florida. The actual dates when Mercury will begin non-renewals is subject
to approval by the
Florida Department of Insurance, and the notice requests approval by March 2011. Current
customers need not worry, the claims department will remain fully staffed and available for any situation that
may arise, and will remain so even during the non-renewal period.

Coming early 2011, drivers who use Florida's Turnpike will no longer need to stop to pay for tolls. The project
is called "The Less Stressway," where everyone can drive in any lane, with no tollbooths, and no slowing
down. There are several notable advantages to "The Less Stressway" project: 1) it's safer because drivers no
longer need to make decisions about which lane to choose. 2) it's more convenient because with no stops,
there's no time wasted. 3) it's better for the environment because less stops means less air pollution. 4) it
actually saves drivers money by requiring less fuel consumption due to a steadier flow of traffic.

Effective July 1st, 2010 cameras installed in traffic lights - “traffic infraction detectors” will be used to enforce
red light violations. Within 30 days of the traffic infraction, an initial violation notice will be mailed to you. If not
paid within 60 days, a traffic citation will be issued. Of course, you have the right to examine the photographic
evidence for yourself. The fine for running a red light is $158 for the first offense.

On June 22, the Florida Department of Highway Safety and Motor Vehicles presented a CarFit event for
mature drivers. CarFit is a program developed by AAA, AARP, AOTA, and the American Society on Aging, to
find out how seniors and their cars “fit” them. Simple modifications and adjustments are made to automobiles
that promote driver safety. As our population grows, older programs like this become more important.

The Florida House has passed a wide-ranging measure to reinforce the State's property insurance market by
raising rates and reducing claims costs for insurance companies. The bill, SB 2044, cleared the Florida
Senate and was approved by the House with a minor change. If the Senate makes additional changes to the
bill, it would have to go back to the House before it's sent to Gov. Charlie Crist to sign or veto.

On April 7, 2010 the Office of Insurance Regulation notified the Department of Financial Services (DFS) that
Northern Capital Insurance Company is bankrupt and unable to meet its financial obligations. It’s expected the
DFS will immediately petition the court to place Northern Capital in receivership. Should liquidation be ordered
all polices will be cancelled before 30 days pass from the liquidation order.

Florida Court reverses a 12 million dollar DUI judgment. After drinking at a party in 2001 students from Carroll
catholic high school crashed their car. One person was killed and another left with severe brain damage. In
2008, a Miami-Dade jury found Carroll High School partly to blame because they promoted the party. Last
week the lower court decision was overturned absolving the school of liability.

Local Miami NBC TV brought news about State Farm Florida car insurance rate hikes of 9%. This comes on
the heels of Allstate’s increases of as much as 16% for some of their customers. 125,000 of State Farm
policyholders are going to have their home insurance contract non-renewed and lose a
multi policy discount
applied to their
Florida auto insurance policy adding to the increase.

On January 13, 2010 Progressive insurance company will require new personal identification procedures for
some applicants. This is being implemented to help reduce fraud and keep rates low for all drivers. Customers
may be required to present their drivers license for a photocopy to be retained in their file. The down payment
for these policies must be made by credit card or personal check.

Beginning in 2010 a new Florida law for drivers with multiple at-fault accidents goes into effect.  Drivers who
are at-fault in three or more accidents within a three year time period will now be required to complete a driver
improvement course.  The course must be approved by the
DMV and will include actual training driving a car
and an assessment of the person’s ability.

Director of the Florida Highway Patrol, Colonel John Czernis, has implemented a zero tolerance holiday
enforcement strategy.  There will be sobriety checkpoints and saturation patrols to remove drunk drivers from
the road.  Every Florida Highway Patrol officer will be scheduled a shift this month to target drivers under the
influence of alcohol or drugs.  Auxiliary and Reserve troopers will be used during peak travel periods.

State Farm insurance company and Florida insurance commissioner Kevin McCarty reached an agreement
that will keep State Farm from exiting the property insurance market.  Under the proposed agreement State
Farm will be allowed to cancel approximately 15% of their policies and raise rates approximately 15%.  State
officials said the agreement is better than State Farm cancelling all of its 810,000 home and condo policies.

Companies are adjusting rates and rules to compensate for increasing fraud.  Personal Injury Protection (PIP)
coverage is the main target for phony claims.  Consumers can expect increased underwriting (investigation)
when purchasing a new Florida car insurance policy.  Progressive now requires a photo ID to verify identity for
a PIP policy.  A variety of new measures is underway by most companies to combat fraud.
